We Reserve The Right To Refuse Service…

This came to me from good friends in Texas.  Not being a lawyer (or playing one on the Internet) I don’t know it it crosses any legal lines with regard to discrimination.

There is that line between running one’s business as one sees fit versus discrimination and bigotry.

  1. As I understand it Texas is one of a few states where the proprietor can refuse service to any one for any reason.

  2. Discrimination and bigotry, along with hate and outright nasty personalities are, and always will be, perfectly natural and can’t be subject to any “law” in a free society. You are perfectly free to be as bigoted as you please, and nobody has any legitimate right to impose on your right to association, free speech and private property.

    In your own home and on your own property, this should never even be a question. If you are trying to run a business, experience should quickly teach that such attitudes do not build a good customer base and your cash flow might be impeded, but you still have the right to do business with whomever you choose, regardless of the reason.

    So, the only actual line between running one’s business as one sees fit, and any kind of discrimination is one of economic reality and getting along with one’s neighbors. It is no more a fit subject for the “law” than is what you have for breakfast.

    If you insist on some form of “government,” government employees and their policies must be forbidden to discriminate. And good luck with THAT.

    Police Shoot and Kill Man Near Times Square
    Officials said the man, who police observed smoking marijuana on 44th Street and 7th Avenue, became agitated when officers approached him. He then pulled out an 11-inch knife and raised it over his head. Officers ordered him to drop the weapon, but he refused, police said.

    Just imagine what might have happened if the police had minded their own business and left this man alone.

    Probably nothing at all. Non news… we’d never have heard of him since he wasn’t harming anyone and was simply standing there smoking. We can deal with the idea of what he was smoking another time, but it is obvious that it presented no danger to anyone either.

    But! But – he had a KNIFE!! I can hear the screaming from here. Calm down.

  5. Legally, he can discriminate against Obama voters since they are not a protected class. But Muslims…under state and federal law, discrimination on the basis of religious beliefs isn’t allowed, and by virtue of being a business and soliciting the public, he’s liable to run into trouble with that one if the muslims or their liberal attack dogs want to make a case.

    And FWIW, I Am a lawyer. 😉
