The “Lawful Purpose and Self Defense Act” Has Been Proposed!

On Wednesday, May 24, 2017, Chairman of the House Committee on Natural Resources Rob Bishop (R-UT) introduced H.R. 2620, the “Lawful Purpose and Self Defense Act.”This bill would remove ATF’s authority to use the “sporting purposes” clauses in federal law in ways that could undermine the core purpose of the Second Amendment. Under Chairman Bishop’s legislation, all lawful purposes – including self-defense – would have to be given due consideration and respect in the administration of federal firearms law.

While the NRA’s announcement above is poorly written, the message is clear.  WE (gun civil rights advocates) are becoming the vanguard.

Sporting purpose never had a place in the Second Amendment.  Period.  Nice we are on the right side, for once.

It is easy for those of us who live in states without “assault weapon” ban (or worse) restrictions to thumb our nose at shooters in California, New York and New Jersey. Some of the compliant builds I have seen would make any respectable shooter want to cry. But how does the saying go: “walk a mile in a man’s shoes”? Having lived in enemy territory for a decade, I can sympathize with our range-loving brothers and sisters being held captive by ridiculous regulations.

Sure, I can see the comments section filling up now: “shall not be infringed”, “will not comply” or better yet  “F*** California”. It may seem simple to just brush off whole sections of the country as lost when you don’t know anyone who lives there. But, if you have family or shooting buddies in California or New York, you may actually start to sympathize with their plight and understand why they buy, build and use the guns and gear they do.

As a writer here at TFB, I probably haven’t done a great job at highlighting the important work being done by manufacturers catering to restricted-style products. So in an attempt to turn things around, I asked for help from the social media powerhouse #hashtagtical who works alongside organizations like The Calguns Foundation to promote responsible gun ownership in California. Of course, we steer clear from politics here, but any organization that promotes the safe and legal use of firearms obviously gets my support.

 

Now, “top 5” lists can be annoying and seem like click bait – you know, like the rags in the grocery line with headlines that read ‘41 ways to please your… Boss’. And we’ve reported on a few of these products before. However, I’d like to start with this story, take input from our readers, and move forward with additional products in the future. LWRCI CA Compliant Modifications

FROM MILES V.’s SHOT 2017 COVERAGE: LWRC’s answer to the new California compliance laws is a sort of spring operated plunger that deactivates the magazine release once the upper receiver is assembled onto the lower receiver. Field stripping the rifle and ‘popping the top’ allows the plunger to be released, and the magazine to be released naturally by pressing the magazine button. To facilitate the field strip, LWRC has extended the rear take down pin to include a sort of port that makes gripping it easier, but also allows for a piece of 550 cord or likewise material to be threaded through the port and creating a loop to pop the rear take down pin out. Those who believe Rights are given to them by government, versus those who believe Rights are inherent, and only partially enumerated by government.

And the piling-on and discussion brought me back to the ubiquitous question – WHAT constitutes a Right?

There’s the Right to keep and bear arms

The Right to free speech, assembly and worship

Trial by jury

The Right NOT to self-incriminate.

Due process

The Right to legal representation

Speedy trial

No search without a warrant (I know, pretty funny!  Given the NSA, FBI, DHS, Border Patrol, DUI checkpoints, etc.)

But, then, folks pile on…

The ‘Right’ to Health Care

The ‘Right’ to ‘Free’ College

The ‘Right’ to a base income from government

Gay rights

Women’s rights

Animal rights

The right to privacy

Ad infinitum, ad nauseaum…

Subscribing to a libertarian philosophy, I believe in self-ownership, and by extension, personal property.  And the non-aggression principle.  Neither persons (or corporate persons or governments) may deprive me of my self-ownership (life, liberty or property) without due process of law.

This includes my labor and the fruits of my labor (taxation is theft).

AND compelling me to support someone else involuntarily is also! (paying for anothers’ health care, college, income.  Redistribution of wealth (socialism/Fabianism/communism) are methods by which this is achieved.

NOT compatible with our capitalistic constitutional Republic.

NOW, if I CHOOSE to help others voluntarily with the fruits of my labor, that’s a whole ‘nother thing!  Then it becomes my choice.

What does this mean for the ‘right’ to drive?  Well, if that person purchases fuel, which has road use taxes, I suppose.

Why Gun Control Doesn’t Work – An Example

Here’s an actual headline I did not make up…

SAFE Act seems to fail at keeping guns from criminals

You guys remember the New York Secure Ammunition and Firearms Enforcement Act of 2013, right? It was going to make New Yorkers safe from scary-looking rifles and standard-capacity magazines, as well as restricting ammo sales and forcing shrinks to snitch on their patients. Thus, you know, ushering in the glorious millennium or some thing, I dunno.

And here’s a total shock: In addition to turning virtually every New York gun owner into a felonious scofflaw, it doesn’t do any of the things promised! Wow. It’s just so out of the blue. Who saw that coming?

Undismayed, New York Attorney General Eric Schneiderman attacks the problem head-on with strawmen and buzzwords blazing:

“Target on Trafficking: Analysis of New York Gun Crimes” found that 74 percent of guns used in a crime recovered in New York came from outside this state.Of these, 70 percent originated “in just six states with weak gun laws — the states along I-95 that make up the Iron Pipeline,” says an online presentation on the report.

Yes, of course it’s not the fault of New York’s well-meaning totalitarians. They wrote a perfect nightmare of a law, which would have worked perfectly if not for all those other state lawmakers with all those weak gun laws! Yeah!

“The Iron Pipeline.” I love it. I hope whichever writer came up with that one got paid a generous bonus. Then had a piano fall on his head.

Surprising to me, though, is that the article writer actually dares point out that it ain’t necessarily so…

However, the report’s data shows that the percentage of crime guns from out of state remained remarkably even before and after New York’s SAFE Act was passed in 2013. From 2010 to 2015, it only fluctuated between 73 and 75 percent. The number of recovered crime guns went down, along with the violent crime rate throughout the Northeast, but the out-of-state percentage stayed the same.

[B]y Mr. Schneiderman’s measure, it hasn’t worked. If the out-of-state gun percentage had spiked since the new restrictions took effect, that might indicate criminals were being foiled here and turning more often to other states, but that doesn’t seem to have happened.

Careful there, kid. Speaking truth to power works best from a respectful distance.

Translates as “Let justice be done, though the world perish”.  Apparently it’s not really a phrase from the Roman Empire but from a book in 1563.   Wikipedia says:

This sentence was the motto of Ferdinand I, Holy Roman Emperor, probably originating from Johannes Jacobus Manlius’s book Loci Communes (1563). It characterizes an attitude, which wants to provide justice at any price. Its first documented use in English literature was about half a century later.

Humans want to believe the worst about persons whom they already despise.  It makes it easier to put them in the why would I want to elect THEM column.
You should really go and read the whole blog post before casting your vote Tuesday.
Not forgetting about Benghazi, the Clinton Foundation, Hillary’s gun control plans, the illegal sale of plutonium to Russia, arming ISIS, the countless mysterious deaths and intimidations, Bill’s serial rapes…
(I could go on – but I have to go take some Pepto now.)
This does NOT mean I am actively supporting the Republican candidate!  He may be a pig and has used inappropriate language, and at best is a populist (see Huey Long)
Libertarians?  Two governors with scant international experience?  One of who is a rebranded, gun-controlling Democrat?!  And the Presidential candidate supports global-warming taxes?!
(I’m not even mentioning the Greens or the Commies…  I know, I’m being redundant)
So VOTE.  Vote not with your heart, but with your brain.

I Agree With Bill Maher!

This makes two times!

Bill Maher said Donald Trump is right that the U.S. should have a profiling service that uses techniques employed by security guards in Israeli airports. The HBO host also said people already profile and that “all police work is profiling,” we just do it “stupidly.

BILL MAHER: He is for profiling, that’s what he said. But he said we should do it the way Israel does. And, like, every once in while Donald Trump says something right. Because we profile already, we just do it stupidly. All police work is profiling. Discrimination does not mean prejudice; discrimination means telling un-like things apart…

Mr. Maher began as a ‘comedian’, claiming he is a ‘libertarian’, then skewed far left (one presumes to attract a bevy of leftist sycophants?)  Most of the time, he seems to agree with the progressives (“I think America needs to be dragged to gov’t healthcare, kicking and screaming if necessary.”).  He says he owns two guns, with which he practices, in case of a home invasion, but has come out for repeal of The Second Amendment!

And there are so many things that make the Conspiracy folks go crazy in every story. Sometimes I wonder if they are right.

Ferinstance, this guy’s story has a lot of holes in it (starting about 2:40) (“The bullet was as big as my finger and it was sticking out of his leg (shows 6 inches)”)…. Makes one wonder. (Plus admitting that you might have trapped others to die?)

It would seem that the incident of gun massacres are increasing. I am beginning to wonder if they are all real whackjobs (as opposed to staged things) especially when I see “witnesses” like the above…It is odd that we had so few until a few years ago….Almost as if the farther behind the gun grabbers get, the harder they try the murderous gun whackos grow bolder….

Odd that.

I used to know a psychologist (NOT as a patient) with whom I was discussing the PROGRAMMING OF HUMAN BEINGS.  The discussion came about not because of the excellent film The Manchurian Candidate (the original, not the poor remake), but because of accusations Sirhan Sirhan (the poor bastard who was convicted of shooting Robert Kennedy from behind, even though he was never behind him!) had been programmed by folks wanting Kennedy dead for his pro-Israeli stance.  (Of course, Sirhan DID shoot many around Kennedy).
I had been reading a sketchy book regarding the assassination, and had questions, thinking I would be laughed at for bringing programming up.
The shrink told me we had been involved in programming since the 50’s, and had picked up much of it from the Soviets (this conversation was in the 80’s), who had begun research in the 40’s!!
YES.  There are lone nut-jobs out there.  And YES, conspiracy theories abound.
But it IS interesting that while any kind of mass shooting now gets increased media attention, that more seem to happen when there is an election looming.  And, of course, The Left is there at-the-ready with numerous, poorly-written screeds in an effort to pass more anti-rights legislation (also pre-prepared, well in advance).
Directed against the law-abiding citizen.

A Brief Note from the Executive Director

Dear Guffaw,

Earlier this week, Gun Owners of America emailed you about Obama’s latest gun grab — a ban that is aimed at Social Security recipients who want to pass on their gun collections to their children and grandchildren.

Unfortunately, we neglected to include in that email, the sample text which can be sent to the Social Security Administration.  It was posted on the web version of this alert, but was not included in the email.

I apologize for that omission.  

You can now find the sample text below, with instructions on how to send it to the Social Security Administration — thus registering your opposition to these diabolical regulations which jeapordize gun collections in hundreds of thousands of American homes.

How to Take Action

The Social Security Administration has posted regulations here.  And they are inviting comments from the general public.

While you can fax or mail your comments, they “strongly recommend that you submit your comments via the Internet.”

So here’s what to do:

  • Visit the Federal eRulemaking portal at http://www.regulations.gov.
  • Use the “Search” function to find docket number SSA–2016–0011.
  • Submit your comments, using the pre-written text suggested below or by uploading your own text.

NOTE:  The regulations state that, “The system will issue a tracking number to confirm your submission.  You will not be able to view your comment immediately because we must post each comment manually.  It may take up to a week or more for your comment to be viewable.”  

You have until July 5 to submit your comments.

Suggested Response to the Social Security Administration (below) 

To Whom It May Concern:

I am writing to you regarding the SOCIAL SECURITY GUN BAN — docket number SSA–2016–0011 — which was formally published in the Federal Register in May.

I am in opposition to this rule and urge the administration to withdraw it.

We have seen this game before at the hands of the Veterans Administration:  To date, over 250,000 law-abiding veterans who have served their country honorably have had their constitutional rights stripped from them.

The VA claims veterans can contest the removal of their rights — and can petition to have them restored.  This rule claims the same right to petition.

But you know — as does the VA — that that process costs at least $10,000. In fact, to be successful, the cost would be more like $20,000 to $100,000. 

For this reason, data shows that a tiny fraction of these veterans have successfully used these illusory mechanisms to reclaim their rights.

Under this proposed rule, if a person is on Social Security disability by reason of a mental health impairment, then their gun rights are gone. Period.

The regulation promises to aggressively search for and take away the gun rights of Social Security Disability recipients with PTSD, ADHD, post partem depression, Alzheimer’s, etc. 

But understand this:  Some parts of the regulation, like the definition of “adjudicated as a mental defective” in proposed CFR 421.105, are applicable to all Title II recipients, including old-age programs. 

Make no mistake: It is clear to everyone that your hidden agenda (disarming seniors) is much broader than your ostensible agenda (disarming the disabled).

Thus, under this language, if a senior can’t “manage their own affairs,” they are specifically acknowledged by the Social Security Administration as being a “mental defective” for purposes of making them a prohibited person. 

Barack Obama claims that this regulation would involve 75,000 persons (who would unconstitutionally lose their fundamental rights), but you understand that the number is more likely to be in the multiple hundreds of thousands.

Then you propose to turn in the names of these innocent law-abiding Americans to the FBI, for the sake of unilaterally stripping them of fundamental constitutional guarantees — all without a hearing or any due process whatsoever.

And, while you propose to do this on the basis of your victims’ incompetence (“mental defect”), you simultaneously assume they are competent to know what you are doing to them — and to round up and dispose of all their firearms in order to avoid becoming Instant Felons. 

You probably don’t know this and probably don’t care:  But octogenarians are not a high-crime demographic.  Very large numbers of them have firearms which they intend to pass on to their children, however.

And most of them would be surprised that they were being turned into “Instant Felons,” subject to SWAT teams and potential prison sentences.

I understand you’re marching to the beat of a Leftist political drummer.  But understand this:  groups like Gun Owners of America will work with Congress to defund this corrupt exercise. 

And every senior citizen in America will go into the polling booth this fall with the knowledge of your unsuccessful little effort to turn them into criminals.

For all these reasons, and more, I urge you to withdraw the SOCIAL SECURITY GUN BAN — docket number SSA–2016–0011.
